CW-2007-0020Kolhapur, MaharashtraJudgment 22 March 2007

The State of Maharashtra vs Kolhapur Police Inspector and others

Arun Pandav, 25, was picked up from his home around midnight on 16.12.1985 by Shahupuri police probing an elopement case and found dead with 19 injuries in the lock-up on 17.12.1985. The Sessions Court acquitted all 11 accused policemen, accepting a heart-failure theory. The court held Arun died of assault in the lock-up, the arrest panchanama and station records were fabricated, and convicted accused Nos.1-3 under ss.302/342/218/193 r/w s.34 IPC with concurrent life terms, upholding the acquittal of the other eight. Later proceedings: on 19 November 2013, the Supreme Court of India set aside the order recorded in this judgment (concerning [name withheld], [name withheld]); the outcome recorded here therefore does not stand. Matters not addressed in the cited judgment text are not recorded here.
