ConcludedThe Jharkhand High Court recorded adverse findings against police personnel and ordered Rs 20,000.
The judgment of the Jharkhand High Court records the following account. On 12 August 2005 Ranchi traffic police seized trekker JH-01-E-9057 at Jail Chowk, which the petitioners alleged followed their refusal to pay illegal gratification, and falsely implicated an advocate who took up the matter in a Motor Vehicles Act case. The Jharkhand High Court held the respondents could neither legally nor factually justify the seizure, the year-long detention of the vehicle, or the prosecution of a man who was neither owner nor driver. The court quashed the seizure and criminal proceedings as sheer abuse of process, ordered the vehicle released forthwith, and awarded Rs. 20,000 compensation payable within one month. Matters not addressed in the cited judgment text are not recorded here.
