Conviction
ConcludedThe trial court convicted the accused police personnel, as recorded in the Gujarat High Court judgment.
The judgment of the Gujarat High Court records the following account. Constable and Head Constable of Naroda Police Station visited timber trader [name withheld]'s premises in December 1986 after a sales-tax complaint, a bailable matter, and agreed to accept Rs.3,000 for not seeking remand after arrest. The ACB trap recovered part-payment of Rs.800 plus blank signed papers from the head constable's portfolio. The Special Judge convicted both officers in 1989. The Gujarat High Court rejected the mistaken-identity defence, confirmed the conviction, but reduced the two-year sentences to three months' RI given the age of the case; no formal sentence order was passed for the second appellant, who died during the appeal.
