CW-2008-0004Patna, BiharJudgment 28 February 2008

Rail Police Constable vs The State of Bihar and Others

A Division Bench of the Patna High Court upheld the dismissal of Bihar Police constable of the Rail Police Centre, Patna, caught by the DSP (Rail) on 30 July 1996 checking tickets from passengers on platform No. 1 at Patna Junction in plain clothes and extorting money, then fleeing across the tracks. Found guilty after enquiry, he was dismissed in 1997, affirmed in appeal and memorial, and his writ was dismissed by a Single Judge in 1999. The Division Bench rejected pleas of denial of cross-examination, parity with a co-delinquent, and disproportionality, noting a second identical proceeding against him, and dismissed the LPA. Matters not addressed in the cited judgment text are not recorded here.
