Conviction
ConcludedThe trial court convicted the accused police personnel, as recorded in the Gujarat High Court judgment.
The Gujarat High Court (M.D. Shah, J.) on 23 July 2008 partly allowed Criminal Appeal No. 1055 of 1993, upholding the corruption conviction of traffic policeman by the Special Judge, Ahmedabad city (26 July 1993). The court held proved beyond doubt that, while attached to Traffic Court (Court No. 13) Gheekanta, he demanded money at Rs. 15 per complaint from auto-rickshaw driverW.-1 to dispose of 15-16 pending traffic complaints and accepted Rs. 150 in an ACB trap on 27 December 1989. It rejected the defence that he took the money only to secure the driver's court presence, holding police officials were not authorised to collect fine amounts directly. Given ~19 years had passed, it reduced the three-year sentences to one year rigorous imprisonment on all counts, concurrent. Matters not addressed in the cited judgment text are not recorded here.
