Conviction
ConcludedThe trial court convicted the accused police personnel, as recorded in the Gujarat High Court judgment.
The Gujarat High Court (M.D. Shah, J.) on 30 September 2008 partly allowed Criminal Appeal No. 775 of 1993, upholding the corruption conviction of two Naroda Police Station constables by the Special Judge, Ahmedabad (29 June 1993). The court held proved beyond doubt that they demanded and accepted Rs. 1,000 illegal gratification from scrap trader [name withheld] on 1-2 December 1989 for not registering a case over missing purchase bills, relying on the panch witness and ACB officer evidence from the trap with marked notes. It rejected the defence that the notes were thrust on them during a summons visit. Given ~20 years had passed, it reduced appellant No. 1 [name withheld]'s sentence from three years to one year rigorous imprisonment on all counts; appellant No. 2 [name withheld] died during appeal so no sentence order was passed for him.
