ConcludedThe Jharkhand High Court upheld service punishment imposed on police personnel.
The judgment of the Jharkhand High Court records the following account. On 26 May 2001 Railway Police constables, [name withheld] and [name withheld], while on duty at the Jamshedpur railway platform, extorted Rs 500 from a Gitanjali Express passenger; G.R.P. Case No. 31/2000 (as stated in the judgment) under Section 386/34 IPC was lodged. All three participated in departmental enquiries, were held guilty, were dismissed by the Superintendent of Police, Railway, in July-August 2002, and their appeals were rejected by the DIG, Railway, in June-July 2003. The Jharkhand High Court (Ajit Kumar Sinha, J.) held full opportunity was given, natural justice was followed, and the court could not reappreciate concurrent findings of fact under Article 226. All three writ petitions were dismissed on 17 December 2008, so the dismissals stand; the court made no finding on the criminal charge itself.
