Adirampattinam Man v. Government of Tamil Nadu and Others

The Madras High Court Division Bench (Justices P.K. Misra and R. Subbiah, judgment by R. Subbiah, J.) dismissed both the State's and the heirs' appeals against the 8 August 2003 single-judge award of Rs 3 lakh for an Adirampattinam man's illegal detention. Taken to Athirampatnam police station on 27 November 1994 over a robbery complaint, an Adirampattinam man was kept in unrecorded custody till production before the Magistrate on 3 December 1994 with severe injuries, a detention the State admitted in appeal. Upholding the award with interest lying in deposit (releasable via the Registrar General), the Court held D.K. Basu guidelines were given a go-by and Article 21 violated. Matters not addressed in the cited judgment text are not recorded here.
