Ahmedabad Boy v. State (NCT of Delhi) and Others

The Delhi High Court (Justices Badar Durrez Ahmed and Ajit Bharihoke) awarded Rs 2,70,000 from the State of Gujarat to Tasleema and her 13-year-old son, a 13-year-old boy. The Court found that on 25 May 2008 SI (SOG, Ahmedabad Crime Branch) with three constables took the boy from Seelampur, Delhi to an Ahmedabad lockup without reason or authority of law while ostensibly searching for an accused in FIR No.840/06, without seeking Delhi Police help or disclosing the removal. Inflation-correcting the Rs 50,000 awarded in Bhim Singh (1985) via the CPI-IW, the Court granted strict-liability public-law compensation within two weeks, rejecting Gujarat's plea for a s.340 CrPC complaint against the mother. Matters not addressed in the cited judgment text are not recorded here.
