CW-2009-0016North West Delhi, DelhiJudgment 12 October 2009

Delhi Armed Police Constable (No.7570/DAP) vs Union of India & Anr.

Constable was dismissed on 24 June 1997 under Article 311(2)(b) without a regular enquiry for association with the Bhoori gang and failure to report his knowledge of the April 1997 murder of K.S. Rana; his appeal, revision and CAT challenge all failed. The Court held there was material showing gang association and that he admitted knowing of the murder yet never informed his superiors, upheld dispensing with enquiry, and found no perversity in the concurrent orders. The writ was dismissed. No civilian victim of the officer himself is identified; the finding concerns criminal nexus and concealment, not absenteeism alone. Matters not addressed in the cited judgment text are not recorded here.
