State of Karnataka vs Bengaluru Police Police Constable (PC No. 2545)

The judgment of the Karnataka High Court records the following account. Police Constable (PC No. 2545) of Mico Layout Police Station, Bengaluru, brought a helpless woman to the police station at about 1 a.m. in 1983 and sexually abused her, for which the enquiry officer found the departmental charges proved and he was dismissed on 19 August 1994. His criminal conviction had been set aside by the High Court in Crl.A. No. 154/1986 on benefit of doubt, and the Karnataka Administrative Tribunal ordered reinstatement with full benefits. The High Court held the acquittal was not honourable and the Tribunal erred, allowing the State's writ petition in part. The dismissal was converted to compulsory retirement with terminal benefits but no benefits for the dismissal-to-judgment period. Matters not addressed in the cited judgment text are not recorded here.
