Conviction
ConcludedThe trial court convicted the accused police personnel, as recorded in the Kerala High Court judgment.
The Kerala High Court Division Bench (judgment by P. Bhavadasan, J.) dismissed the appeals of [name withheld], a serving Deputy Superintendent of Police, and a second accused against their life sentences imposed by the Sessions Court, Kottayam (S.C. No. 145/2005) for the gruesome murder of an Ettumanoor man, a former driver, on 15 February 2005, and dismissed the State appeal seeking the death sentence. The Court held the prosecution proved murder by the guardian of law with hired accomplices over a personal grudge, with the body dismembered after death. It held that although a police officer crime must normally be viewed very seriously, the case fell outside the rarest-of-rare category, so capital punishment was refused. The Supreme Court dismissed [name withheld] further appeal (Crl.A. No. 1774/2010) on 4 February 2013, leaving the life sentence final.
