New Delhi Man and Others v. The Commissioner of Police and Others

The Delhi High Court (Justice S. Muralidhar) awarded mason Prempal Rs 5,32,750 with 6% interest from his arrest plus Rs 30,000 costs for years of police harassment culminating in a false rape case (FIR No. 231/2002). The Court relied on the final, unappealed 2004 acquittal by the Additional Sessions Judge, who had found a New Delhi man framed because he complained against police officials, tortured in custody, and reduced to a living corpse. Holding his Article 21 rights brazenly violated, the Court limited compensation to the FIR 231/2002 incarceration, directed the Commissioner to send a written apology to the family and review other pending cases against a New Delhi man, and noted the IO had earned only a forfeiture-of-service punishment.
