CW-2010-0038Alwar, RajasthanJudgment 22 November 2010

Alwar Police Head Constable vs State of Rajasthan and Others

Head Constable was trapped on 07.10.1997 and convicted by the trial court under PC Act 1988 ss.13(1)(d)/13(2), sentenced to two years RI with Rs.5,000 fine; his criminal appeal (No.240/2001) remained pending with only the sentence suspended. After repeated suspension-reinstatement cycles the SP Alwar removed him on 08.03.2010 on the ground of conviction, and the Single Bench dismissed his writ on 19.04.2010. The Division Bench held the corruption conviction renders the appellant totally unfit to continue in service, the pending appeal was of no avail since the conviction was not stayed, and prior hearing would have been an empty formality. It held the removal appropriate and lawful and dismissed the special appeal.
