ConcludedThe Madras High Court recorded adverse findings against police personnel and ordered Rs 200,000.
The judgment of the Madras High Court records the following account. Accused a Puliyangudi man (Puliyangudi PS Cr.No.277 of 1998) hanged himself in the Puliyangudi lock-up on 16.09.1998 using his lungi as a noose. Grade I Constable faced departmental charges of letting the detainee keep the lungi, failing lock-up watch, fleeing after seeing him struggle, keeping no detention record and creating a false document, all held proved in PR No.125 of 2000. A Division Bench had ordered Rs.2 lakh compensation to widow [name withheld] (W.P. No.11569 of 1999, 2009 (3) MLJ 702), and the State fixed recovery shares on four policemen including Rs.33,684 on the petitioner. The Court held the petitioner had already suffered a penalty on the same score, the State was right in ordering recovery, and dismissed the writ.
