CW-2011-0022Jabalpur, Madhya PradeshJudgment 5 December 2011

Jabalpur Man v. State of Madhya Pradesh and Ors.

The Supreme Court held there was no warrant for handcuffing the appellant, a coaching-centre owner trapped in a question-paper sale case on 8 June 1992, and that the unjustified handcuffing with published photographs adversely affected his dignity and led to tragic consequences including his sister death from shock. The Court found the ensuing trial dragged over 12 years till acquittal in August 2004, with five years delay attributable to the prosecution. It agreed with the Madhya Pradesh High Court Division Bench that Rs 70,000 did not do justice to the suffering and humiliation. It enhanced compensation to Rs 2 lakh payable by the State, without prejudice to a damages claim. Matters not addressed in the cited judgment text are not recorded here.
