Conviction
ConcludedThe trial court convicted the accused police personnel, as recorded in the Delhi High Court judgment.
The judgment of the Delhi High Court records the following account. ASI, investigating officer of FIR No. 304/93, demanded Rs 500 per court hearing from the accused [name withheld] in exchange for weakening the evidence, and accepted the money at Patiala House Courts in a CBI trap on 28 October 1996. The Special Judge convicted him under Sections 7 and 13(1)(d) of the PC Act and imposed four years RI per count in September 2001. The Delhi High Court held demand, acceptance and recovery proved beyond reasonable doubt through the complainant, shadow and recovery witnesses and matching tainted notes with positive hand washes. It maintained the conviction, reduced the sentence to two years RI on each count concurrent, dismissed the appeal and ordered the accused taken into custody.
