ConcludedThe trial court convicted the accused police personnel, as recorded in the Bombay High Court judgment.
The judgment of the Bombay High Court records the following account. Head Constable of Sahar police station took a ~14-year-old beggar girl in an autorickshaw on 17.10.2005 and sexually assaulted her near a temple wall until a passer-by intervened. The trial court convicted him under ss.363, 366, 376(2)(a) and 323 IPC with 15 years RI for rape. The court held the victim a minor whose consent was irrelevant and kept the ss.363/366/323 convictions, but held penetration unproved, converting the rape conviction to attempt under s.376(2)(a) r/w s.511 IPC with sentence reduced to imprisonment already undergone plus Rs.10,000 fine payable to the victim.
