CW-2012-0004Janjgir-Champa, ChhattisgarhJudgment 15 February 2012

Janjgir Man and Another v. State of C.G.

The Chhattisgarh High Court awarded Rs 1.5 lakh additional compensation to Motimbai and her child for the custodial death of Chhotelal Soni, forcibly taken by respondent No. 6 from Balco to Janjgir-Champa on 11 September 1999 and beaten brutally in transit custody, dying the same day. The State Human Rights Commission had already found custodial death, awarded Rs 50,000 recoverable from respondents 5 and 6, and recommended their suspension and enquiry, in which they were punished. Following Nilabati Behera and related precedents, the Court held the police deprived the deceased of personal liberty and allowed the petition with liberty to claim more in private law. Matters not addressed in the cited judgment text are not recorded here.
