CW-2012-0008RajasthanJudgment 21 May 2012

Rajasthan Man vs State of Rajasthan & Ors.

The judgment of the Rajasthan High Court records the following account. A Rajasthan man had surrendered on 9 September 1985 and was acquitted on 6 March 1992, but the 1985 arrest warrant was never recalled. The court found that police arrested him on 16 May 2005 on that dead warrant, kept him overnight at the police station despite his protest, and he secured bail only on 19 May 2005. The Division Bench held the arrest grossly negligent and illegal, set aside the Single Bench order denying relief, and awarded Rs 25,000 compensation with 6% interest on default. It also directed the DGP, Rajasthan to review dead warrants and order yearly reviews. Matters not addressed in the cited judgment text are not recorded here.
