CW-2012-0013Mohla-Manpur-Ambagarh Chowki, ChhattisgarhJudgment 14 August 2012

State of Madhya Pradesh (now Chhattisgarh) vs Manpur Police Constable and others

The Chhattisgarh High Court Division Bench (Abhay Manohar Sapre, J.) allowed the State's writ appeals and upheld the 30 September 1993 dismissal of five PS Manpur police personnel — two constables, two head constables and the Town Inspector. Three major misconducts in discharge of official duties, including misappropriation of money found on gamblers caught on the night of 11/12 December 1992, were held proved in a regular departmental inquiry. The Court set aside the Single Judge's 4 April 2011 reinstatement order, holding the inquiry findings were serious, proved in accordance with law, and earlier concurrently upheld by the State Administrative Tribunal in 1997. Matters not addressed in the cited judgment text are not recorded here.
