ConcludedThe Gauhati High Court recorded adverse findings against police personnel and ordered Rs 150,000.
The Gauhati High Court awarded Rs 1,50,000 to the widow of head teacher a Mushalpur man, who died in custody at Mushalpur Out Post on 26 October 2007 after being detained the previous day for interrogation. While unconvinced of physical torture, the Court held the police grossly negligent: a Home Guard let the detainee carry a gamosa into the toilet, no arrest memo was prepared, the family was never informed, and the post-mortem was conducted without them. The Court found the detainee's right to reputation and the D.K. Basu safeguards under Articles 21 and 22(1) infringed without justifiable cause. The court found Home Guard grossly negligent, but he is a Home Guard volunteer under whose vigil the deceased was left at Mushalpur Police Out Post, not a member of the police force. Matters not addressed in the cited judgment text are not recorded here.
