Order issued
ConcludedThe Madras High Court recorded adverse findings against police personnel and ordered Rs 380,000.
The Madras High Court dismissed the writ petition of three police constables and upheld the recovery of Rs.76,000 from each toward the Rs.3,80,000 compensation the State paid to the mother of a Chennai man, aged 24, who was beaten to death in the custody of E-2 Royapettah police station in June 1993. The court held that the petitioners, who were heard as party-respondents in the compensation writ (W.P. No.14879 of 1994), had let the findings and the recovery direction become final without appeal. It held that neither their acquittal in the criminal trial, where witnesses turned hostile, nor the setting aside of departmental penalties debarred recovery, since public-law compensation serves a different purpose. The writ petition was dismissed and the recovery sustained. Matters not addressed in the cited judgment text are not recorded here.
