ConcludedThe Supreme Court of India upheld service punishment imposed on police personnel.
On 9 July 1999 the respondent, an Armed Reserve police constable on Courtallam-season bandobust duty, went to Tenkasi bus stand in a drunken state and eve-teased a married woman waiting with her husband, threatening to book a case against the husband; he was taken into custody by head constables on night duty and dismissed from service on 4 January 2000 after disciplinary proceedings. He was acquitted in the criminal case under Section 509 IPC and the Tamil Nadu Prohibition of Eve-Teasing Act, and the Madras High Court set aside the dismissal and ordered reinstatement with back wages. The Supreme Court held the criminal acquittal was on technical grounds rather than honourable and no bar to the departmental penalty, allowed the State appeal, set aside the High Court judgment and restored the dismissal. The Court additionally issued eight directions to States and Union Territories to curb eve-teasing. Matters not addressed in the cited judgment text are not recorded here.
