CW-2014-0014Faridabad, HaryanaJudgment 4 April 2014

Faridabad Man vs The State of Haryana and Others

The judgment of the Punjab and Haryana High Court records the following account. A Faridabad man, a 34-year-old factory worker detained from 5 to 7 February 1996 in a theft case, died in the police-post lock-up on 7 February 1996 after consuming acid kept in the toilet. The SDM Faridabad's inquiry examined 24 persons and concluded the Incharge Police Post was grossly negligent and ASI guilty of abetment to suicide, finding death in custody after mental depression, physical torture and humiliation. The criminal trial under Sections 342/306/120-B IPC had ended in acquittal in 1997, but the High Court held that was no bar to compensation under Articles 32/226 following Nilabati Behera. The Court allowed the petition and directed the State to pay the widow Rs.7,39,400 with 9% interest from filing till realisation within three months. Matters not addressed in the cited judgment text are not recorded here.
