CW-2014-0021Banka, BiharJudgment 7 March 2014

Bausi Police Assistant Sub-Inspector vs State of Bihar

The judgment of the Patna High Court records the following account. ASI, investigating a theft case at Bausi police station, demanded Rs. 200 from the accused to file a final report in his favour, and was caught in a vigilance trap with the marked notes. The Special Judge (Vigilance) convicted him under section 161 IPC and section 5(1)(d) of the Prevention of Corruption Act 1947, sentencing him to 1.5 years' rigorous imprisonment plus Rs. 1,000 fine on each count. The Patna High Court held the demand and acceptance proved through trap witnesses, rejected attacks on the non-examination of the deceased complainant, and dismissed the appeal without reducing the sentence.
