ConcludedThe Meghalaya High Court recorded adverse findings against police personnel and ordered Rs 40,000.
The judgment of the Meghalaya High Court records the following account. Taxi driver [name withheld] was intercepted near Nongthymmai on 09.09.2011, taken to Madanriting Traffic Branch over an alleged traffic offence, and assaulted by UBC [name withheld] when he could produce only Rs. 170 of the demanded fine, suffering a bleeding lacerated injury to his left eye. A departmental proceeding had already found the constable guilty beyond any shred of doubt and imposed censure. The High Court held the assault an established infringement of the indefeasible right under Article 21 and awarded Rs. 40,000 as exemplary damages payable jointly or severally by the State, DGP and SP within 40 days. It directed recovery of Rs. 10,000 from the respondent constable salary after payment to the petitioner. Matters not addressed in the cited judgment text are not recorded here.
