State of M.P. vs BSF Head Constable

The judgment of the Madhya Pradesh High Court records the following account. On the night of 8-9 May 1990, BSF Head Constable, living upstairs in the same Tekanpur Academy quarter building, lured his 8-year-old neighbour upstairs on the pretext of opening a lock and sexually assaulted her. The trial court acquitted him under Sections 376/511 IPC on 8 April 1994 giving benefit of doubt over a contradictory medical re-examination. In the State's appeal under Section 378 CrPC, the Madhya Pradesh High Court held the trial court erred in recording a simpliciter acquittal as it was a clear-cut case of outraging the modesty of a minor girl, and that no fresh Section 354 charge was needed as it is a cognate offence under Section 222 CrPC. The Court set aside the acquittal, held him guilty under Section 354 IPC, and, noting almost 24 years had passed, imposed only a fine of Rs. 25,000 with six months' RI in default, issuing a non-bailable warrant as he remained absent.
