CW-2014-0033ChhattisgarhJudgment 11 November 2014

Chhattisgarh Police Police Constable vs State of Madhya Pradesh (now Chhattisgarh)

The judgment of the Chhattisgarh High Court records the following account. Police Constable was served a three-charge memo on 3 April 1989 alleging 75 days of unauthorized absence from 21 October 1988 to 4 January 1989, uncultured language toward the department, and incorrigibility despite earlier punishments. He never participated in the departmental enquiry, which proceeded ex parte on five witnesses and eight documents and found charges 1 and 3 proved, leading to dismissal on 9 September 1989. He contended that regularization of the absence period against unearned leave wiped out the charge. The Chhattisgarh High Court held the regularization order merely adjusted leave and did not recall the dismissal, that the punishment was severably sustainable on charges 1 and 3, and that discipline in a uniformed service should not be lightly interfered with, dismissing the writ petition. Matters not addressed in the cited judgment text are not recorded here.
