CW-2014-0038Dhanbad, JharkhandJudgment 17 December 2014

Chirkunda Police Constable vs State of Jharkhand and Others

The judgment of the Jharkhand High Court records the following account. Constable, appointed in the Gumla District Police in 1999 and posted at Chirkunda Police Station, Dhanbad, was charged with reporting for and remaining on duty in a drunken state and abusing colleagues and the public during 2009-2010. A regular departmental enquiry, supported by the Officer Incharge's evidence and four prior punishments for similar conduct, proved the charges, and he was dismissed in April 2010 with his appeal rejected. The Jharkhand High Court found he had been given repeated opportunities but chose not to appear, and held his conduct unfit for a government servant under the Conduct Rules. The Court declined to reappraise concurrent findings under Article 226 and dismissed the writ petition. Matters not addressed in the cited judgment text are not recorded here.
