ConcludedThe Calcutta High Court recorded adverse findings against police personnel and ordered Rs 300,000.
The judgment of the Calcutta High Court records the following account. On 4 September 2003 a Uttarpara man (35) was riding home on G.T. Road when he failed to stop at a night check; police constable shot him dead with his service revolver and then fabricated a firearm injury on himself to plead private defence. A Sessions Court convicted [name withheld] of murder with life imprisonment in April 2008, and a departmental enquiry held the firing intentional, excessive and unjustified; the State still rejected the mother's compensation claim. The Calcutta High Court held the infringement of the fundamental right established through the criminal verdict, rejected the State's limitation and scheme objections, and directed the State to pay a lump sum of Rs 3 lakh within eight weeks. On the mother's intra-court appeal a Division Bench in December 2022 upheld the findings and enhanced compensation by a further Rs 5 lakh (total Rs 8 lakh).
