Conviction
ConcludedThe trial court convicted the accused police personnel, as recorded in the Karnataka High Court judgment.
The judgment of the Karnataka High Court records the following account. On the midnight of 1 January 2002 a quarrel near police quarters in Jyothinagar, Mysore, allegedly sparked by bursting crackers after 11 p.m., led to [name withheld], a DAR police constable, and his son assaulting neighbours with a reaper patti and a wicket; a case and counter-case were registered at Nazarbad Police Station. The Fast Track Court-IV, Mysore convicted both appellants under Section 324 IPC in 2010. Justice Budihal R.B. held the trial court's view was neither perverse nor capricious, confirmed the conviction and dismissed the appeal, finding the accused in the connected appeal were the aggressors. Accepting that accused No.1 was a first-offender government servant, the Court maintained his conviction but released him on probation of good conduct after admonition, directing the conviction should not affect his service. Matters not addressed in the cited judgment text are not recorded here.
