CW-2015-0020DelhiJudgment 30 January 2015

Delhi Police Sub-Inspector vs Union of India & Ors.

The Delhi High Court (S. Ravindra Bhat and Vipin Sanghi, JJ.) on 30 January 2015 dismissed the writ petition of Delhi Police Sub-Inspector and upheld his dismissal from service. The court recorded that he wilfully absented himself from ASIAD control-room duty on 19 November 1982 despite direct orders, and in December 1982 circulated leaflets among Special Branch staff pressing personnel demands and instigating formation of a Delhi Police union. After an earlier dismissal was set aside on procedural grounds, a fresh enquiry held both charges proved and he was dismissed again on 4 June 1991. The court found no arbitrariness in the Disciplinary Authority's order, held principles of natural justice were adhered to, and declined to interfere with the Tribunal's orders. This is an internal-discipline case with no civilian victim. Matters not addressed in the cited judgment text are not recorded here.
