CW-2015-0021Hazaribagh, JharkhandJudgment 4 February 2015

Jharkhand Police Hawaldar vs The State of Jharkhand and Others

The Jharkhand High Court (Sujit Narayan Prasad J.) dismissed a Hawaldar's writ against his dismissal dated 31 March 2004. The court found the enquiry had proved, on witness depositions and documents, that he stalked a Hazaribagh woman under a false identity, misused his service pistol, threatened adverse newspaper publicity, and demanded Rs. 3 lakhs. It held that writ review examines only whether the disciplinary conclusion rests on evidence, and that the petitioner had been heard at every stage. The dismissal, already affirmed in appeal and memorial, therefore stands.
