CW-2015-0023Katihar, BiharJudgment 18 February 2015

Railway Protection Force Constable vs The Union of India and Others

The Patna High Court sustained the dismissal of RPF Constable, imposed on account of his conviction for kidnapping and raping a minor girl and Arms Act offences for which he served ten years imprisonment. The court held that though the order dispensing with an enquiry lacked foundation, a remand would be a useless formality given the admitted heinous conviction involving moral turpitude. It declared the dismissal illegal with retrospective effect but kept it in operation prospectively from 15 September 2011, with back salary for 1993-2011. The dismissal therefore stands.
