Jharkhand Armed Police Constable vs The State of Jharkhand and Others

The Jharkhand High Court (Pramath Patnaik J.) dismissed a Jharkhand Armed Police constable's writ against his dismissal dated 30 October 2007. The court found he had concealed a previous criminal case and judicial custody at appointment, which it held amounts to grave misconduct, particularly in a disciplined service like the police. It held that unshown prejudice from enquiry-report handling could not vitiate the proceeding and that the major punishment was proportionate. The dismissal, confirmed in departmental appeal on 20 August 2008, therefore stands.
