CW-2015-0030Uttar PradeshJudgment 21 July 2015

U.P. Police Constable v. State of Uttar Pradesh and Others

The Allahabad High Court (Division Bench, 21 July 2015) dismissed Special Appeal No. 1905 of 2010 and sustained the dismissal dated 7 September 2002 of police Constable under Rule 8(2)(a) of the 1991 Rules, imposed on the ground of conduct leading to his trial-court conviction for murder and life sentence. The Court recorded that the appellant's writ petition (No. 70001 of 2009) had already been dismissed by the single Judge on 20 July 2010 following S. Nagoor Meera (AIR 1995 SC 1364). The Court held there was no substance in the plea that a stay of sentence in the pending criminal appeal entitled him to reinstatement, since the conduct underlying the conviction was not stayed. The special appeal accordingly failed and was dismissed, with no compensation ordered; this judgment does not itself adjudicate the murder charge.
