ConcludedThe Madras High Court recorded adverse findings against police personnel and ordered Rs 786,000.
A Division Bench of the Madras High Court (Madurai) dismissed the writ appeal of [name withheld] [name withheld] against the single judge's order dated 01.07.2011 awarding Rs.7,86,000 compensation to Hasanammal for the custodial death of her husband [name withheld]. The single-judge order (W.P.(MD)No.8138 of 2008) records that Kadayanallur police took a Keeriparai man from his residence on 28.11.2005, handed him to Aralvoimozhi police, and kept him in illegal custody at Keeriparai police station from 28.11.2005 to 30.11.2005, where he was tortured by third-degree methods causing death on 30.11.2005 at 11 p.m., with the body disposed of - findings supported by the RDO enquiry, the Collector, G.O.Ms.No.1322 dated 27.11.2008 and the CBCID investigation. The police had originally claimed he was released and his whereabouts were unknown (appeal para 3). The Division Bench noted the State had paid the compensation without appeal (para 6) and that a CBCID charge sheet under Section 302 IPC was pending trial before the Sessions Court (para 4). It held the compensation findings could not clinch any officer's culpability and the trial would proceed on its own evidence (para 8), and dismissed the appeal (spellings: '[name withheld]' per the appeal cause title; '[name withheld]' in the single-judge cause title).
