CW-2016-0007Bilaspur, ChhattisgarhJudgment 28 September 2016

Takhatpur Police Head Constable and others v. State of Chhattisgarh

The judgment of the Chhattisgarh High Court records the following account. A Takhatpur man, a labourer suspected of theft at his employer's house, was taken by PS Takhatpur police from his village on 5/6 January 1992 and beaten with lathis through the night at a school building in Bandha for 14-15 hours; he died en route to hospital. The trial court convicted two policemen and two civilians for murder. The Division Bench sustained the conviction but altered it from Section 302 to Section 304 Part II/34 IPC with ten years' rigorous imprisonment each, upheld the Section 331 IPC conviction for grievous hurt to extort confession, and set aside Section 149. The court relied on D.K. Basu in condemning the custodial torture; the incident predates Chhattisgarh's formation, when the area was in Madhya Pradesh. Matters not addressed in the cited judgment text are not recorded here.
