CW-2016-0008Patna, BiharJudgment 16 November 2016

The State of Bihar and Others vs Patna Police Constable and others

A Division Bench of the Patna High Court restored the dismissal of CID Dog Squad constable [name withheld], caught red-handed with Rs 40,000 blackmail money by a raiding party on 8 August 1988. Though convicted in the criminal case in 1994 and acquitted on appeal in 1996, he was dismissed after a departmental enquiry, a penalty affirmed in appeal and memorial but set aside by a Single Judge in 2013. The Division Bench held the Single Judge had impermissibly re-appreciated evidence, found no procedural infirmity on perusing the original file, and held criminal acquittal does not conclude departmental proceedings. The LPA was allowed and the writ dismissed. Later proceedings: on 23 April 2025, the Supreme Court of India set aside the order recorded in this judgment (concerning [name withheld] [name withheld]); the outcome recorded here therefore does not stand. Matters not addressed in the cited judgment text are not recorded here.
