Vadakara Man vs Vadakara Man and Others

The judgment of the Kerala High Court records the following account. In May 2012, Sub Inspector of Vadakara Police Station took 70-year-old retired teacher a Vadakara man into custody for alleged smoking in public; the victim alleged he was dragged by the collar, abused in public, lost a gold chain, and suffered a heart attack after release on bail. A disciplinary enquiry followed and the officer did not oppose the writ petition; the Single Judge directed Rs.1,00,000 be paid out of the officer's salary. The Division Bench dismissed the officer's appeal, recording its own finding that he was guilty of misconduct, acted without due diligence and violated the D.K. Basu custody guidelines, and confirmed the salary-recovery direction within two months. Matters not addressed in the cited judgment text are not recorded here.
