Aslam Bux vs State of Rajasthan & Ors.

The Jodhpur Bench of the Rajasthan High Court dismissed the writ petition of Constable Aslam Bux, upholding his dismissal from service by the Superintendent of Police, Udaipur, following a departmental enquiry into seven charges arising from FIR No. 03/1999 under Sections 366, 368, 372, 373 and 376(g) IPC for raping the prosecutrix and selling her to another person. Although the Fast Track Court at Pali had acquitted him in the criminal trial on benefit of doubt, the High Court held that the prosecutrix had deposed afresh before the enquiry officer asserting the rape and sale, so the departmental finding of guilt stood independent of the criminal acquittal. The Court held the enquiry fair and lawful, with full opportunity to cross-examine, and ruled that no punishment lesser than dismissal was possible for a police constable involved in such a case.
