CW-2017-0038DelhiJudgment 28 November 2017

Delhi Police Head Constable vs Govt. of NCT of Delhi & Ors.

The Delhi High Court (Hima Kohli and Rekha Palli, JJ.) on 28 November 2017 dismissed in limine the writ petition of Delhi Police Head Constable and upheld his dismissal from service. The court recorded that he had contracted a second marriage on 8 February 1996 without legally divorcing his first wife, and that a full departmental enquiry in which both wives were examined held the charge of grave misconduct proved. It rejected his plea that the first marriage was unproved, noting corroboration from the ration card, CGHS card and nomination records. Relying on Union of India v. P. Gunasekaran, the court held dismissal for such misconduct unbecoming of a member of a disciplined force was not disproportionate. Matters not addressed in the cited judgment text are not recorded here.
