ConcludedThe Madhya Pradesh High Court recorded adverse findings against police personnel and ordered Rs 200,000.
The judgment of the Madhya Pradesh High Court records the following account. Appellants Durga and a Badoni man, who were already lodged in jail in another case, were falsely implicated in an abduction-for-ransom case registered at Badoni Police Station, Datia, and sentenced to life imprisonment by the Special Judge. The Madhya Pradesh High Court (Gwalior Bench) acquitted both appellants, observing that the test identification parade was vitiated by police mischief who pre-showed the accused to the victim and fabricated evidence to frame innocent persons. Holding that the appellants' right to life under Article 21 was severely violated by tainted prosecution and poor investigation, the High Court ordered the State to pay Rs. 1,00,000 compensation each within two months, with liberty to recover the cost from erring investigating officers. Matters not addressed in the cited judgment text are not recorded here.
