CW-2018-0021Buxar, BiharJudgment 4 January 2018

Bihar Police Constable v. State of Bihar and Others

Constable, appointed on compassionate ground in Buxar, was dismissed on 16.01.2007 (with effect from 12.01.2007) for repeated prolonged unauthorised absence, about 128 days during basic training and 82 days on Durga Puja duty in 2006; his appeal was rejected in 2009. He pleaded violation of natural justice and produced jaundice certificates only with the writ. The Court held natural justice is not a strait-jacket formula, police discipline and larger public interest outweighed the individual interest of an unconfirmed absconder, and no illegality or infirmity vitiated the impugned orders. The writ application was dismissed. Matters not addressed in the cited judgment text are not recorded here.
