CW-2018-0027Dumka, JharkhandJudgment 17 September 2018

Jharkhand Police Constable v. State of Jharkhand and Others

Constable, appointed in Dumka in October 2004 and sent for training to CISF Regional Training Centre, Arkonam, absented himself from 18.02.2005, was suspended, and was dismissed on 16.12.2005 after a departmental proceeding found the absconding charge established; his appeal was rejected on 15.03.2011. His defences of his wife's illness and his own treatment did not avail. The Court found he never participated in the enquiry despite repeated notices, the 2011 appellate rejection was merited, and the writ suffered unexplained seven-year delay. Finding no ground for interference, the Court dismissed the writ petition. Matters not addressed in the cited judgment text are not recorded here.
