CW-2018-0029Meerut, Uttar PradeshJudgment 31 October 2018

Meerut Police PAC personnel & Ors. v. State of Uttar Pradesh & Ors.; Meerut Man & Anr. v. State of UP

The Delhi High Court reversed the Tis Hazari acquittal and convicted 16 UP PAC men for the Hashimpura massacre of 22 May 1987, when C-Company jawans rounded up 42-45 Muslim men of Meerut, shot about 38 in batches at Gang nahar and Hindon canal and dumped the bodies in the water. Charge-sheeted only in 1996 with trial transferred to Delhi, all had been acquitted in 2015 for want of identification; on appeal with NHRC-intervenor additional evidence, the High Court held it targeted killing of unarmed defenceless persons. Each was sentenced to life (remainder of natural life) under Section 302/120B plus concurrent terms for conspiracy, kidnapping, attempt to murder and destruction of evidence, and ordered to surrender by 22 November 2018. State corrected to Uttar Pradesh (incident site; trial in Delhi). Matters not addressed in the cited judgment text are not recorded here.
