CW-2019-0005Wayanad, KeralaJudgment 8 July 2019

State of Kerala vs Wayanad Man

Author and researcher a Wayanad man was detained and interrogated by police in Wayanad on 20 May 2014 on suspicion of being a Maoist, a suspicion the court found was not based on any valid material, and his residence was thereafter searched by officers accompanied by Thunderbolt commandos without following CrPC procedure. The single judge awarded Rs 1,00,000 compensation with Rs 10,000 costs. A Division Bench affirmed, holding that the detention, interrogation and search were wholly unjustified, that a person cannot be persecuted merely for holding Maoist ideology, and that the compensation was neither exorbitant nor unreasonable, dismissing the State's writ appeal.
