Ahmednagar Man v. State of Maharashtra

The judgment of the Bombay High Court records the following account. Three members of an advocate family were arrested on 26 October 2014 in bailable offences and kept in the Kotwali lockup before being remanded to police custody till 29 October, with bail refused. The Additional Sessions Judge had already held in revision that the arrest, detention and remand order were illegal. The High Court agreed, holding the circumstances showed apparent malice on the part of PSI. It allowed the petition and directed total compensation of Rs 5 lakh to all petitioners together within 45 days, leaving the State free to recover the amount from the officer after due procedure. Matters not addressed in the cited judgment text are not recorded here.
