CW-2019-0028Datia, Madhya PradeshJudgment 25 April 2019

Datia Police Constable No. 492 vs State of Madhya Pradesh

The judgment of the Madhya Pradesh High Court records the following account. Constable of the 29th Battalion SAF, Datia, overstayed sanctioned leave from 10 June 2000 and reported back only on 16 April 2001, a 310-day unauthorised absence, with ten prior punishments for similar absences. After a departmental enquiry found both charges proved, the Commandant removed him from service on 30 June 2001 and the appeal was dismissed on limitation. The court held the petitioner showed no prejudice from the presiding officer also acting as presenting officer, so the enquiry stood. It held removal proportionate to admitted habitual misconduct and dismissed the petition on merits and on delay and laches. Matters not addressed in the cited judgment text are not recorded here.
